TOPerf — Terms of Use

The present terms of use govern the use of the TOPerf application published by InforConsult. By using the application, you accept these terms.

1. Application Purpose

TOPerf is an application designed to assist pilots in calculating takeoff performance from user-provided data.

The application notably enables:

Calculation of takeoff distances
Analysis of safety margins
Consideration of weather and runway conditions
Export of reports in PDF format

Calculations are performed using mathematical models based on data from manufacturer documents (POH) entered by the user.

2. Application Use

The user commits to using the application in accordance with applicable regulations and solely for personal use purposes.

The user is responsible for the accuracy of data entered in the application.

3. Important Warning (Aviation)

TOPerf is an educational decision-support tool intended for student pilots, private pilots, and instructors.

Calculations provided by the application are based on user-entered data and information from aircraft flight manuals (POH). Despite careful development, the application may contain errors or inaccuracies.

Results from TOPerf should be considered indicative only and never replace official aircraft documents or applicable operational procedures.

Calculations must always be verified by the pilot, particularly in degraded conditions such as:

Short runways
Contaminated runways
Unfavorable meteorological conditions
High aircraft mass
Significant runway slope

The application accounts for aircraft limits as defined in the POH but does not account for the pilot's experience, skills, or personal limitations.

The application indicating a takeoff is possible does not necessarily mean conditions suit the pilot's experience level.

The pilot remains solely responsible for flight preparation, performance verification, and any operational decision.

When in doubt, consulting an instructor or referring to official aircraft documents is recommended.

TOPerf is not a certified tool and is not intended as the sole source for operational flight preparation.

4. Limitation of Liability

The publisher strives to ensure calculation accuracy but cannot guarantee the absence of errors or inaccuracies.

Consequently, the publisher cannot be held responsible for any direct or indirect damage resulting from application use or interpretation of provided results.

5. Data Export

The application may generate PDF reports. These reports are generated locally on the user's device and remain under their control.

6. Advertising

The application may display advertisements from third-party services such as Google AdMob. Advertisement display is subject to relevant provider policies.

7. Intellectual Property

TOPerf, its design, algorithms, and content are protected by intellectual property laws. Any unauthorized reproduction, modification, or distribution is prohibited.

8. Application Modifications

The publisher reserves the right to modify, suspend, or update the application at any time to improve functionality or comply with regulatory changes.

9. Terms Modification

These terms of use may be updated. The most recent version will be published on the application's official website.
